But seriously, a hoodlum standing in your driveway does not warrant a pull of the trigger. There are steps one must take first. Especially in a case where there is no immediate threat to your life.
I have no doubt the kid was up to no good. But a billet to the head was unjustified. Now this guy (who's intention we're not evil) is going to go down for attempted 2nd degree (if the kid doesn't die) and his child, wife, and baby are going to suffer for his stupidity.

Wait didn't the kid climb a fence to gain access to the guy's property? Newsflash, if you don't enter property that's fenced, chances are pretty good no harm will come to you. Does that warrant getting shot? I'm not saying it does, but a fence says keep your ass out.

hypothetical:
somebody late at night, is smashing the window in your house, and standing outside the broken, open window to your 9 year old daughter's bedroom. You're outside on your driveway watching with a loaded shotgun. Would you shoot?
somebody is sitting in your car, in your driveway, apparently ripping out the dash and your 1500 dollar head unit and iPod. You run from the front door of your home with a pistol cocked, what do you do? Drag the robber out and pistol whip him? Shoot him in the face? Tell him "freeze mo'fucka" while holding the gun on him and dialing the police?
I'm guessing we're about to get hit with a lot of "don't shoot that innocent boy because he got caught doing something stupid! Let him run off, and you can file a report with your local authorities instead"
1st scenario:
I view home entry, especially where the intruder is headed directly towards a loved one as justification for disabling the intruder by any means necessary.
Second scenario:
Is loss off material property ever justifiable cause for the taking of a life? Also consider that a responsible person should have valuable possessions insured.

1) he's just standing there, with a crowbar in his hand. He's not attempting to enter the dwelling. You yell for him to leave, and he doesn't. He doesn't move, or speak.
2) he jumps out of the car while you're holding the gun on him, but the car door swings toward you and shields him for a split second, and you see him moving behind the door looking like he's pulling something out of his pants. At best, he's going to run away with your stereo. At worst, he has pulled a weapon while concealed and is about to end your life.
what do you do?

you can feel like your child is in danger, but is it immediate danger, is it danger of grave bodily harm?
the guy in the car is screaming don't shoot, while he moves around behind the door, where you can't see what he's doing. Then he pops up and prepares to either lunge at you or jump away, something is in his hand, it's black and you don't really know what it is, it's dark.
blam, you fire your weapon, you have three things on your side.
first, he didn't freeze when told.
second, he made a sudden move.
in his hand is a small cordless drill.
he's shot through the neck, breathing heavily through blood, dying in your driveway.
do you:
shoot him again
help him from bleeding out, and call paramedics/911
watch him wriggle on the ground thinking, "uh huh, that's what you get for stealing from me" then go to your garage fridge for a beer.

The case with the guy at my daughters bedroom window is pretty cut and dry. The intent to me is clear enough.
The one with the guy in the car is harder. For two reasons: the law won't always be on your side and you concocted a case with a lot of gray areas and I value life the willingness to take someone's life should always be a last resort, but not at the risk of losing your own.
But in either case a tazer would be a sufficient tool to properly diffuse the situation and detain the intruder until the authorities arrive. Now I'm sure you can add some variable that would render the tazer useless as well. So tell me, what would you do? And how do these scenarios compare with some punk that simply jumped your fence?
When I was a kid we played neighborhood wide hide seek games and jumping fences, running through yards was part of the fun. Kids do dumb shit.

Scenario, Chicago is closing down the projects, the hoodrats are moving downstate to gain cheap housing and a new place. So Danville, IL, Blue collar total white trash town AND... now... hoodrats.
2 hoodrats shooting at each other in some dude's back yard... 2 dead hoodrats. We got hoodrats breaking into houses and dying on a regular basis. Death warrant here is breaking into some dude's house armed, it's bad, in Chicago you may get by with that having a scared dem cowering. but not here.... what we feel after shooting an intruder in the head is... our ears ringing.
Someone breaks into my house? The last thing they hear will be ye ol scatter blaster!

I don't know what I'd do, it would depend on the amount of adrenalin running through.
I would have the gun out and ready, so either perp would know that they were in jeopardy.
And, if you pull a gun you should be ready to use it, but here you aren't being attacked, you're making a judgment call as to intent.
The robber, you can expect to run but what if they come towards you, do you have the ability to shoot a moving target in time, and do you allow any room for error?
I don't mean to sound cocky or naive. But I am confident in my marksmanship abilities. Especially at distances less than 30'.

It would appear that everyone forgot about the foreign exchange student shot and killed outside the home in Baton Rouge. Exactly what happened to the homeowner in that case again? Look up the Yoshihiro Hattori case when you get a chance. ;)
I'm in Texas. I have the right to protect my home, my family AND my possessions. A few years ago, guy shot a dude in the back running from his friends car and got off.
The idea to not shoot someone over material possessions (short of those possessions necessary for life, water, food, shelter..) is more of a personal morality thing than a legal one.
In fact if I didn't have a family to care for, I'm not sure I would kill someone to save me own life. It's when you endanger those I care about that you rattle my cage.

Post hurricane Gustav I had an attempted home invasion and I didn't shoot my would be intruders. I figured them staring down the other end of an AR-15 with a surefire attached to it was more than enough. The two beating on the door took off running and their driver ran over my neighbor's mailbox with his Nissan Sentra.
The real sickening part is both my cars were at other locations due to a tree falling and only my current wife's, then girlfriend's, car was there... I wonder what those punks had on their mind since they obviously didn't think I was around? Also, the fact that they were literally beating the hell out of the door after midnight when the electricity was out still confuses me... One of the guys did yell "wrong house" before he pissed and shit himself, as well as tripping over the other person, then taking off running.
Lastly, before anyone cries racism, they were ALL white!
